WARRANTY

Lumen Products 10-Year Limited Luminosity Warranty

MOHNZ warrants Lumen Products, for a period of ten (10) years from the date of purchase, only in respect of luminosity performance. Subject to the terms of this warranty, MOHNZ warrants that the luminous output of the products will remain within the applicable published performance specification when the products are installed, used, and maintained in accordance with all applicable instructions and specifications.

1. This warranty applies only to luminosity performance and only where the products have been correctly installed, operated under normal conditions, and maintained in accordance with recommended procedures. Normal reduction in light output over time that remains within the applicable published performance specification is not covered.

 

2. This warranty does not cover any defect, deterioration, failure, or damage other than a qualifying failure of luminosity performance, and does not cover issues arising from misuse, abuse, neglect, accident, fire, flood, other natural events, exposure to harmful chemicals or unsuitable environments, or any use not recommended in the applicable product information or installation guidance.

3. Without limiting clause 2, this warranty is void if:

3.1 the products have been misused, neglected, damaged, abused, or involved in an accident;

3.2 the products have been improperly installed, operated, repaired, or maintained;

3.3 the products have been altered or modified without prior written approval; or

3.4 the products have been used outside their stated specifications, capacity, or operating parameters.

 

4. If a valid claim is made under this warranty and MOHNZ determines, acting reasonably, that the product has failed to meet the applicable luminosity performance specification, MOHNZ will, at its option, repair or replace the affected product or supply replacement materials for the affected component only.

4.1 To the maximum extent permitted by law, this warranty is the sole express warranty provided by MOHNZ in relation to the products.

4.2 To the maximum extent permitted by law, MOHNZ will not be liable for any indirect, special, incidental, or consequential loss, including loss of profit, loss of use, or business interruption, arising out of or in connection with the products or this warranty.

4.3 To the maximum extent permitted by law, MOHNZ’s total liability under this warranty will not exceed the original purchase price paid for the relevant product.

5. To make a claim under this warranty, the purchaser should provide proof of purchase, details of the alleged luminosity performance failure, and any supporting photographs, test data, or installation information reasonably requested by MOHNZ. Any claim must be made promptly after the issue is discovered.

6. This warranty is in addition to any rights and remedies that may be available under the Consumer Guarantees Act 1993 and any other applicable New Zealand law, except where those rights may lawfully be excluded in a business-to-business transaction.
